TERMS AND CONDITIONS

Effective Date: 1 October 2026

Last Updated: 1 October 2026 | Version 26.1 (AU)

PLEASE READ THESE TERMS AND CONDITIONS ("TERMS") CAREFULLY. THEY MAY AFFECT YOUR LEGAL RIGHTS. SECTION 15 EXPLAINS HOW TO MAKE A COMPLAINT, AND SECTION 16 EXPLAINS WHICH LAWS APPLY AND WHERE YOU CAN BRING A CLAIM. NOTHING IN THESE TERMS EXCLUDES, RESTRICTS OR MODIFIES YOUR RIGHTS UNDER THE AUSTRALIAN CONSUMER LAW.

1. ACCEPTANCE OF THESE TERMS

By accessing, browsing or using the www.wrinklesschminkles.com.au website and any other digital property operated by Olsam AU Pty Ltd (ABN 39 688 028 186), trading as Wrinkles Schminkles (together with its related entities, subsidiaries, affiliates and parent companies, "we", "us" or "our"), that links to these Terms (the "Site"), by creating an Account on the Site, by purchasing any goods or services from us, or by signing up to receive text or WhatsApp messages from us (the "Mobile Service"), you accept these Terms, our Privacy Policy and any other applicable promotion-specific or product-specific terms on the Site, each of which forms part of these Terms. The Site, Mobile Service, Account, Subscription Programme, Content, User Content and Third-Party Content are together referred to as the "Offerings". If there is a conflict between these Terms, the Privacy Policy or any promotion- or product-specific terms, these Terms will prevail unless expressly stated otherwise.

If you do not agree to these Terms, the Privacy Policy and any applicable promotion- or product-specific terms, you may not use or access the Offerings.

2. CHANGES TO THESE TERMS

We may update these Terms from time to time, for example to reflect changes in the law or in how we operate. Updated Terms will be posted on the Site and the "Last Updated" date will show when they were revised. The Terms in force when you place an order will apply to that order, and changes will not affect orders you have already placed. If we make a material change that affects an active subscription, we will give you reasonable notice by email before the change takes effect, and you may cancel your subscription if you do not wish to continue.

3. ACCOUNT REGISTRATION

3.1 Account Creation
To access certain features (for example, to track orders or view previous purchases) you may need to create an account with us. By creating an account, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding contract. If you are under 18, you may not create an account, and we may close any account belonging to someone under 18. You may only create one account, for your own personal use. You may not create an account on behalf of anyone else. Joint, family, household, business and shared accounts are not permitted.

3.2 Account Security
You are responsible for keeping your account login details secure, including any password or one-time verification code, and must not share them with anyone. You are responsible for activity carried out through your account unless it results from our failure to take reasonable care to keep your account secure. Please tell us immediately if you suspect unauthorised access to your account. We may restrict, suspend or close account access if we reasonably believe your account has been compromised.

4. ORDERS

4.1 Product Information and Availability
We aim to ensure that all product descriptions, specifications, images, colours, prices and other information on the Site are accurate and up to date, but errors or omissions may occasionally occur. Product features, availability and prices may change from time to time, but changes will not affect orders we have already accepted. Product images and colours are for illustration and may vary slightly depending on your device or screen settings. The display of a product on the Site does not guarantee that it is available.

Our products are cosmetic products intended to improve the appearance of the skin. They are not therapeutic goods or medicines and are not intended to diagnose, treat, cure or prevent any disease or medical condition. Individual results may vary depending on factors including skin type, age and how the product is used. Please read all product instructions carefully and stop using a product if irritation or an adverse reaction occurs.

Product safety. Our products are for external use only. Before using a product for the first time, we recommend a patch test on a small area of skin. Do not apply products to broken, irritated, sunburnt or infected skin, and always follow the directions on the packaging, including any guidance on where and for how long a product should be worn. Stop using the product and remove it immediately if you experience redness, itching, swelling, discomfort or any other reaction, and seek medical advice if the reaction persists. If you have a skin condition, are pregnant or breastfeeding, or have any concerns about whether a product is suitable for you, please speak to a healthcare professional before use. Keep products out of reach of children.

4.2 Prices and Promotions
All prices on the Site are shown in Australian dollars (AUD) and include GST. Delivery charges are shown separately before you place your order. For orders delivered outside Australia, import duties, taxes and customs charges may apply; these are not included in our prices and are payable by you.

Where we show a reference price (such as a "was" price or a recommended retail price), it reflects a genuine price at which the product was previously offered for a reasonable period or a genuine recommended retail price, in line with the Australian Consumer Law.

Promotional offers, discounts and discount codes are subject to their stated terms, may exclude certain products, may not be combined unless expressly stated, and may be changed or withdrawn at any time before an order is accepted.

4.3 Orders and Payment
When you submit an order, you are making an offer to buy the products. Our order confirmation email confirms that we have received your order but does not mean we have accepted it. We accept your order, and a contract between us is formed, when we send you an email confirming that your order has been dispatched.

You confirm that you are authorised to use the payment method you provide and that your payment and billing information is accurate. You authorise us to charge your payment method for the total amount of your order, including GST and delivery charges. If payment cannot be processed, we may cancel your order.

We may limit quantities, decline an order or cancel an order before it is dispatched, for example because of a pricing or stock error, suspected fraud, reseller activity or a breach of these Terms. If we cancel an order after payment has been taken, we will refund the full amount paid to your original payment method.

4.4 Pricing Errors
If a product is listed at an incorrect price, we may cancel your order or contact you for instructions before dispatch. We will not charge you a higher price than the one displayed without your agreement. If an order is cancelled because of a pricing error after payment has been taken, we will give you a full refund.

4.5 Delivery
We will deliver your order to the address you provide, in line with our Shipping Policy. Delivery dates are estimates. We will deliver your order within the delivery timeframe shown at checkout or in your dispatch confirmation. If delivery is delayed by events outside our reasonable control, we will let you know and take steps to minimise the delay. We may deliver your order in more than one shipment.

The products will be your responsibility from the time they are delivered to the address you gave us. If your order is lost or damaged in transit before it reaches you, please contact us and we will arrange a replacement or refund.

4.6 Cancellations, Returns and Refunds
Cancellations, returns and refunds are covered by our Cancellation Policy and our Returns and Refunds Policy, which form part of these Terms. These policies do not affect your statutory rights.

4.7 Your Consumer Rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

The Australian Consumer Law does not give you a right to a refund if you simply change your mind. Any change-of-mind returns we offer are set out in our Returns and Refunds Policy and are in addition to your rights under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law. For more information about your rights, visit the Australian Competition and Consumer Commission at accc.gov.au.

4.8 Subscribe & Save Programme
We may offer a subscription programme that allows eligible products to be delivered automatically on a recurring basis (the "Subscription Programme"). Taking part is optional and subject to product availability.

By joining the Subscription Programme, you authorise us to charge your payment method for each recurring order, including GST, delivery charges and any other amounts shown at checkout. Your subscription will continue until you cancel it or we end it.

The delivery frequency, pricing, discounts, eligible products and other benefits of the Subscription Programme are shown when you subscribe. If we change the price or other material terms of your subscription, we will give you reasonable notice by email before the change takes effect, and you may cancel if you do not wish to continue.

You can cancel, pause, skip, change or manage your subscription at any time through your account or by contacting us. Changes made after an order has been processed will apply from the following order. Further details are set out in our Cancellation Policy.

We may change, suspend or end the Subscription Programme, in whole or in part. If we end it, we will not charge you for any further orders after it ends.

Nothing in this Section limits any cancellation, refund or other rights you have under applicable law.

5. GIFT CARDS

Our gift cards may be used to buy products on the Site. Gift cards bought for value do not expire and are not subject to dormancy, inactivity or service fees. Gift cards cannot be topped up, cannot be exchanged for cash except where required by law, and may not be resold or transferred for value.

Promotional cards, store credit and similar vouchers issued free of charge are not gift cards and may have an expiry date or other restrictions, which we will tell you about when they are issued. Lost or stolen gift cards can be replaced only on proof of purchase and only for the remaining balance. If we end our gift card programme or become subject to insolvency proceedings, your ability to redeem gift cards will be subject to applicable law. Nothing in this Section limits your rights under the Australian Consumer Law, including the rules on gift card expiry and fees.

6. INTELLECTUAL PROPERTY RIGHTS; USER CONTENT; THIRD-PARTY CONTENT

6.1 Definitions
In these Terms:

• "Content" means all materials made available through the Site or Offerings by us or on our behalf, including software, text, pricing information, graphics, logos, designs, audio, video, images and data. Content includes Intellectual Property Content as defined below.

• "User Content" means any content or information you or other users submit, post or otherwise make available through the Site or in connection with us. User Content includes Social Media User Content as defined below.

• "Third-Party Content" means content or information provided by third parties, including service providers. Third-Party Content includes Linked Sites as defined below.

6.2 Content and Our Intellectual Property Rights
All Content, other than Third-Party Content and User Content, belongs to us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site and Content for your own personal, non-commercial use in accordance with these Terms. No ownership rights are transferred to you, and no other use of the Content is permitted without our prior written consent.

All trade marks, logos, designs, branding and patented material on the Site ("Intellectual Property Content") are owned by us or our licensors and are protected by the intellectual property laws of Australia and other countries. No licence to use Intellectual Property Content is granted except as expressly set out in these Terms.

Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, display, publish, create derivative works from or otherwise use any Content or Intellectual Property Content without our prior written consent.

6.3 User Content
By submitting User Content, you grant us a perpetual, worldwide, non-exclusive, royalty-free, irrevocable, transferable licence (including the right to sub-license) to use, host, store, reproduce, modify, publish, display and distribute that User Content for any lawful purpose, including running and improving our business and marketing our products. We may use User Content without payment to you and without any obligation of confidentiality. To the extent permitted by law, you consent to us doing or omitting to do any act in relation to your User Content that might otherwise infringe your moral rights.

We have no obligation to use, review, monitor, return or respond to any User Content. We may monitor, remove, restrict access to or refuse to display any User Content that breaches these Terms, applicable law or the rights of any third party. User Content reflects the views of the person who submitted it, not our views, and we do not endorse or verify it.

If you tag, mention or otherwise link us, our brand hashtags or our social media accounts with content you post on a third-party platform ("Social Media User Content"), you grant us a worldwide, royalty-free, non-exclusive licence (including the right to sub-license) to use, reproduce, publish, display and distribute that content, together with your name, username, likeness, image and statements about us, in connection with our business, marketing and promotional activities. You may withdraw this permission for future use at any time by contacting us, and we will take reasonable steps to stop using the content where it is under our control.

Submitting User Content does not create any confidential, agency, partnership, employment or other special relationship between you and us.

You confirm that: (a) you own or control all rights needed to submit the User Content and grant the rights described in this Section; (b) the User Content does not infringe anyone else's rights; (c) you have obtained all necessary permissions from any identifiable people who appear in or are referred to in the User Content; and (d) if you post Social Media User Content, you have all rights necessary to allow us to use it as described in this Section.

6.4 Third-Party Content
The Site may display Third-Party Content or links to third-party websites, apps or services ("Linked Sites"). These are provided for your convenience only. We do not endorse or control Third-Party Content or Linked Sites and are not responsible for their content, availability, products, services or practices. Linked Sites may have their own terms and privacy policies, which you should read. Your use of any Linked Site is at your own risk.

6.5 Copyright Infringement
We respect intellectual property rights. If you believe that any content on our Site infringes your copyright or other intellectual property rights, please contact us using the details in Section 17 with the following information: your name and contact details; a description of the work you believe has been infringed; the location of the content on our Site (such as a link); and a statement that you believe in good faith that the use is not authorised by the rights owner. We will review all notices promptly and remove or disable access to content where appropriate. We may suspend or close the accounts of users who repeatedly infringe the rights of others.

7. CONSUMER REVIEWS

If you submit a product review or rating, whether through our Site or elsewhere, you agree that it will reflect your honest opinion and genuine experience of the product. If you have received anything in connection with your review, such as a free product, discount, loyalty points or entry into a prize draw, you must make this clear in your review, and we will label it as incentivised when we display it. We do not offer incentives for positive reviews, and we do not suppress, edit or remove reviews because they are negative. We will only remove a review if it breaches these Terms, is unlawful, is unrelated to the product, contains personal information, or is not based on a genuine experience of the product. We do not write, buy or commission fake reviews. We take reasonable and proportionate steps to prevent and remove fake and misleading reviews, and we display reviews in accordance with applicable law, including the Australian Consumer Law.

8. ACCEPTABLE USE

You must use the Offerings only for lawful purposes and in line with these Terms and all applicable laws. You may not use the Offerings for any unauthorised, fraudulent, deceptive, misleading or unlawful purpose.

You agree not to:

• access, attempt to access or get around any restricted part of the Site or any related systems, servers, networks or security measures without authorisation;

• interfere with, disrupt or damage the Site, or introduce any virus, malware or other harmful code;

• reverse engineer, decompile or disassemble any software made available through the Site, except as permitted by law;

• use robots, scrapers, crawlers, data mining tools, artificial intelligence tools or other automated means to access, collect, copy or extract any Content or data from the Site, including to train, test or develop any artificial intelligence or machine learning system, except as expressly authorised by us;

• frame or mirror the Site, alter its appearance or functionality, or use any of our trade marks, logos or trade names without our prior written consent;

• misrepresent your identity, impersonate any person or organisation, falsely imply a connection with anyone, or provide false or misleading information;

• send spam or unauthorised promotional material, or collect personal information about others without authorisation;

• submit User Content that is unlawful, misleading, fraudulent, infringing, defamatory, harassing, abusive or obscene, or that breaches anyone's rights; or

• use the Site in any way that interferes with other people's use of it, or that could expose us, our affiliates, users or service providers to liability, security threats or other harm.

If you use the Site in breach of these Terms, the licences and permissions granted to you under these Terms will end, in addition to any other remedies available to us.

We may investigate suspected breaches of these Terms and take appropriate action, including removing content, restricting access to the Site, suspending or closing accounts, refusing service, cancelling orders, or cooperating with law enforcement or regulatory authorities, subject to applicable law and our Privacy Policy.

9. YOUR CONFIRMATIONS

You confirm that the information you give us is accurate, complete and up to date, and that you will comply with all applicable laws when using the Offerings. You also confirm that you have the legal capacity to accept these Terms and to grant any rights or permissions you give us under them.

You may not buy, use, export, transfer or otherwise obtain products from the Site in breach of any applicable export control, trade sanctions or import laws. You confirm that you are not subject to any sanctions that would prevent us from doing business with you. We may decline or cancel an order if we reasonably believe this is necessary to comply with the law.

10. MOBILE MESSAGE SERVICE

We may offer a mobile messaging programme (the "Mobile Service") that sends recurring marketing and service messages by text message (SMS) and/or WhatsApp, including promotions, offers, product announcements, cart reminders, order updates, delivery notifications, account-related messages, security alerts and similar communications.

By signing up to the Mobile Service, you: (a) consent to receive recurring marketing messages from us, or sent on our behalf, by text message and/or WhatsApp (as you have chosen) at the mobile number you provide, including messages sent using automated technology; (b) confirm that you are the account holder or regular user of the mobile number provided and will let us know promptly if it changes; and (c) acknowledge that your consent is not a condition of purchasing any goods or services. We will only send you marketing messages where you have given your consent or where otherwise permitted by the Spam Act 2003 (Cth) and the Privacy Act 1988 (Cth). Every marketing message will identify us and include a way to unsubscribe.

Message frequency varies. Standard network or data charges may apply. WhatsApp messages are delivered through WhatsApp (part of Meta) and are also subject to WhatsApp's own terms and privacy policy. Neither we nor any mobile network or messaging provider is responsible for delayed, failed or misdirected messages.

You can stop receiving marketing messages at any time by replying STOP to any message or by contacting us using any other reasonable means. You may receive one final message confirming that you have been unsubscribed. We will act on your request promptly, and in any event within 5 business days. You will continue to receive service messages relating to any orders you have placed. For help, reply HELP to any message or contact us.

Taking part in the Mobile Service is voluntary. We may change, suspend or end the Mobile Service, including any telephone number or WhatsApp account used to provide it, at any time. Changes to this Section are governed by Section 2. Our Privacy Policy explains how we collect and use your mobile number.

11. ACCESSIBILITY

We are committed to making the Site accessible to everyone, including people with disabilities. If you have difficulty accessing the Site or any of our products or services, please contact us using the details in Section 17 and we will do our best to help, including by making reasonable adjustments. For more information, please see our Accessibility Statement.

12. OUR PRODUCTS AND THE SITE

12.1 Our Products
Our products come with guarantees under the Australian Consumer Law, including that they are of acceptable quality, fit for any disclosed purpose and match their description. Nothing in these Terms excludes, restricts or modifies those guarantees or your rights under the Australian Consumer Law.

We are not responsible for problems caused by normal wear and tear, misuse, failure to follow the product instructions, or use of a product for a purpose other than its intended use.

12.2 The Site
We provide the Site on an "as is" and "as available" basis. While we take reasonable care, we do not guarantee that the Site will always be available, uninterrupted, error-free or free from viruses, or that its content will always be complete or up to date. We may suspend or change the Site at any time, for example for maintenance or business reasons.

13. OUR RESPONSIBILITY FOR LOSS OR DAMAGE

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, or any liability we have that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence, for fraud, or for safety defects in our products.

Subject to the Australian Consumer Law, if we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a reasonably foreseeable result of our breach or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not reasonably foreseeable.

We supply our products for domestic and private use only. If you use the products for any commercial or business purpose, we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

14. YOUR RESPONSIBILITY FOR LOSS OR DAMAGE

You will be responsible for any reasonable losses, costs and expenses (including reasonable legal fees) that we incur as a direct result of: (i) your misuse of the Offerings; (ii) your providing a mobile number belonging to someone else in connection with the Mobile Service; (iii) your breach of these Terms; (iv) your breach of any applicable law or of the rights of any third party, including any copyright, property or privacy right; or (v) any User Content you submit.

15. COMPLAINTS AND DISPUTES

15.1 Complaints. If you have a complaint about our products, our Site or these Terms, please contact us first using the details in Section 17. Please include your name, order number (if applicable) and a description of the issue. We will acknowledge your complaint promptly and aim to resolve it as quickly as possible.

15.2 Further help. If we are unable to resolve your complaint, you can contact the fair trading or consumer affairs agency in your state or territory, which offers free advice and dispute resolution services. You may also be able to bring a claim in your local civil and administrative tribunal or court.

15.3 Your rights. Nothing in this Section 15 affects your right to bring a claim in a tribunal or court, or any other rights you have under the Australian Consumer Law.

16. GOVERNING LAW AND JURISDICTION

16.1 These Terms, the Privacy Policy and any promotion- or product-specific terms are governed by the laws of New South Wales, Australia, and the Commonwealth of Australia.

16.2 The courts and tribunals of New South Wales have non-exclusive jurisdiction. This means you may also bring proceedings in the courts or tribunals of the state or territory where you live.

16.3 Nothing in these Terms deprives you of the protection of any mandatory consumer laws that apply where you live.

17. CONTACTING US

17.1 The Site is operated by Olsam AU Pty Ltd (ACN 688 028 186, ABN 39 688 028 186), with its registered address at 21 Dorset Road, Northbridge NSW 2063.

17.2 You can contact us by email at hello@wrinklesschminkles.com or by telephone on 1800 841 876. Our customer service team is available Monday to Friday, 9am-5pm Sydney time.

18. ELECTRONIC COMMUNICATIONS

By using the Offerings, you agree that we may send you agreements, notices and other communications electronically, including by email and through the Site, and that these satisfy any legal requirement for communications to be in writing. If you sign up to receive marketing emails, you can unsubscribe at any time using the unsubscribe link in the email or by contacting us at hello@wrinklesschminkles.com. Marketing text and WhatsApp messages are covered by Section 10 and require separate consent.

19. GENERAL PROVISIONS

ENDING THESE TERMS
You may stop using the Offerings and close your account at any time. We may suspend or close your account, or stop providing the Offerings to you, by giving you reasonable notice. We may do so immediately if you seriously breach these Terms, if we suspect fraud or misuse, or if it is necessary for security or legal reasons. If we close your account, we will still fulfil, or refund in full, any orders we have already accepted, unless we are closing it because of your breach of these Terms. You remain responsible for paying for any orders you have placed before your account was closed.

19.1 Entire Agreement
These Terms, together with our Privacy Policy, our Cancellation Policy, our Returns and Refunds Policy and any promotion- or product-specific terms, make up the entire agreement between you and us. Nothing in this Section affects your rights in relation to any description of the products or other information we have given you or any rights you have under the Australian Consumer Law.

19.2 Severability
If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be treated as removed from these Terms, and the rest of these Terms will continue in full force and effect.

19.3 Waiver
If we do not insist straight away that you do anything you are required to do under these Terms, or if we delay in taking action, this does not mean we have given up our right to do so later.

19.4 Transferring These Terms
You may not transfer your rights or obligations under these Terms to anyone else without our prior written consent. We may transfer our rights and obligations under these Terms to another organisation, for example to an affiliate or as part of a merger, acquisition or reorganisation. We will make sure that any transfer does not affect your rights under these Terms.

19.5 Events Outside Our Control
We are not responsible for delays or failures to perform our obligations caused by events outside our reasonable control, including natural disasters, fire, flood, epidemics or pandemics, war, terrorism, civil unrest, industrial action, government action, carrier delays, utility or telecommunications failures, cyberattacks or supply chain disruption. If such an event delays your order, we will contact you as soon as possible, and you may cancel your order and receive a refund for any products you have paid for but not received.

19.6 Third-Party Rights
These Terms are between you and us. No other person has any right to enforce any of these Terms.

19.7 Geographic Availability
The Site is intended for customers in Australia. We do not represent that the Site or its content is appropriate or available for use in other locations. If you access the Site from outside Australia, you are responsible for complying with local laws.

19.8 Headings and Interpretation
Section headings are for convenience only and do not affect interpretation. "Including" means "including without limitation". If there is any doubt about the meaning of a term in these Terms, the meaning most favourable to you will apply. The English language version of these Terms will prevail.

19.9 Survival
Any provision of these Terms that by its nature should continue after these Terms end will continue to apply, including Sections 6 to 8 and 12 to 20.
